Code of Maryland (COMAR 10.15.03)
The Division of Environmental Health enforces the Maryland Code of Regulations that applies to Food service Facilities, COMAR 10.15.03. It is responsible for the regulation, licensure and inspection of facilities that prepare and/or provide food to the public in Washington County.
Records Request Forms and Complaint Investigation Form
Licensed Environmental Health Specialists from this office investigate complaints involving food service facilities and Maryland Clean Indoor Act violations as well. EH staff respond to requests for well, septic , and perc testing records and FOIA requests.
Food Service Facilities
Prior to remodeling an existing food service facility or constructing a new food service facility, an application and plans must be submitted to the Food Office for review.
Mobile Food Service Facility
In order to operate a food truck/trailer in Washington County, the mobile unit MUST have a food service facility license issued by the Washington County Health Department.
Temporary Special Event Food Service Facility
A temporary special food service facility is a facility operating for a temporary period of time in conjunction with a fair, carnival, recreational facility or other public event. A public event means a planned gathering that is open to the public which is advertised with fliers, newspaper ads, banners, or internet websites as being open to the general public. The event may not last longer than 30 days. A temporary food service facility permit is required to provide food service to the public. Examples are Outdoor carnivals and fairs, Concessions served at sporting events open to the general public, School festivals, Fundraiser events. Applications must be submitted a minimum of 7 days prior to the event for review by our office.
Cottage Foods Businesses
What is a Cottage Food Business? A cottage food business (or a home-based business) is defined in the Code of Maryland Regulations (COMAR) 10.15.03 as: “a business that a) produces or packages cottage food products in a residential kitchen; and b) has annual revenues from the sale of cottage food products in an amount not exceeding $50,000.” Under Cottage Foods Businesses Regulations, you may sell cottage food products made in your home kitchen and stored on the premises without needing any license.
